TERMS & CONDITIONS

Acceptance of terms

  • By making payment for our services, you understand and agree that Yacht Kakis will treat your use of our services as acceptance of our Terms

Booking 

  • Booking is subject to vessel availability

  • Booking confirmation is only upon full payment. Do note that charter availability is subject to first-come, first-serve basis

Cancellation Policy

  • Cancellations made more than 1 month in advance will be given a full refund. However, do note that this is dependent on the yacht owner's policy and guests may be subjected to an administration fee. Cancellations made less than a month, but more than 14 days, will be subject to 50% of the charter fee. Cancellations made under 14 days will not be refundable. 

  • Cancellation of food and beverage services will not be refundable. 

  • The timing at which the cancellation is made also plays a part. Cancellation requests made after office hours will be counted as the next day.

  • In the unforeseen circumstance where the charter has to be cancelled by the Captain (due to bad weather or technical difficulties), the charter will be rescheduled to another date, subject to availability.  

Rescheduling/Delay Policy

  • Free rescheduling of charter date is allowed 1 month in advance. For any rescheduling within 1 month, additional charges may apply based on individual yacht owners as the blocked off time may have affected business.

  • The timing at which the rescheduling is made also plays a part. Rescheduling requests made after office hours will be counted as the next day.

  • If the charterer chooses to reschedule from a Weekend slot to a Weekday slot (higher to lower value), no refunds of the difference will be provided.

  • In the event of inclement weather, the Captain may make the call to delay the charter until the rain subsides and the Charterer will be eligible to an extension of the original end timing, based on the time they set sail.  However, if the inclement weather comes in after the start of the charter and the Captain decides to shorten the charter due to safety, the Operator will not be liable to any refunds or fees.

  • The Charterer is expected to arrive on time for charters. There will be no extension of time should the Charterer or his/her guests arrive late.

  • The Charterer is expected to leave the yacht within 15 minutes of the charter end time.

Agreement With Operators/Owners

  • The Operator/Owner shall ensure that the yacht provided is clean, operable and ready for the client at the agreed charter start time. The operator/owner is responsible that the yacht is in compliance with any safety, insurance and chartering regulations at the start of the charter. Should there be any technical issues before the commencement of the agreed time and the Operator/Owner cannot fulfil the obligation to move out, he/she is obliged to refund the full amount of charter fee collected to the Charterer and there will be no further claims of compensation. 

  • The operator/owner will provide a qualified and licensed Captain in accordance with the vessel's licensing requirements for the charter. A qualified and trained crew member shall also be provided. 

  • Any damage caused to the yacht by the Charterer, or cleaning services needed for the state it was left it, should be charged to the Charterer following the charter. These claims should be followed up with official receipts and must be repaid by the Charterer without protest. In the event of damage to the yacht or equipment, the Charterer may request for photographic evidence and may get their own independent assessment and quote done if they feel the quoted repair sum is unfair. However, the Operator/Owner has the final say in ensuring that the repair/replacement is acceptable on their terms and in compliance of their insurers. 

Use of Yacht and Equipment

  • The Charterer is responsible for ensuring that the yacht and equipment provided is returned in the same condition as it was prior to the charter.

  • Any damages or defects caused due as a result of disregarding the Captain or crew's orders such as but not limited to negligence, drunken or disorderly behaviour will result in the Charterer being liable to pay for reparation or replacement costs.

  • The charterer is responsible for updating the Captain/crew should there be any damages for safety reasons.

  • The charterer understands the risks involved when taking part in water activities and is liable for any damage to equipment, personal injury or to others and personal loss of belongings caused by him or his guests, whether it is with or without intent or through negligence. 

  • Yacht Kakis reserves the sole and exclusive right to cancel any charter if the Captain in his reasonable opinion declares that the sea or weather conditions are not suitable for the charter prior to the scheduled timing and there are reasonable concerns over the safety of personnel or yacht. The Captain has full authority over the safety of the vesssl and personnel, and may any any time terminate a charter and return to the marina if there is any reasonable possibility of danger to the yacht or personnel onboard. If such events are due to technical reasons, the cancellation policy will be applied and discussed. If such an incident occurs due to unsafe behaviour of the Charterer, there will be no refunds. 

  • Once the yacht has departed the Marina, the charter is to be considered as fulfilled and no cancellations or refunds will be provided.

  • The Charterer shall indemnity and acknowledge that Yacht Kakis and its employees shall not be held liable for any death, loss or injury arising from the Charterer's and Guest's usage of the yacht or its equipment.

LIMITATION OF LIABILITY

  • Yacht Kakis Pte Ltd shall not be liable for:

    • Any direct, indirect, incidental or consequential damages which may be incurred by you, however caused and under any theory of liability; including but not limited to loss of profit, loss of goodwill or business, cost of procurement of substitute goods or services or other intangible costs.​
